Terms of Service for Phoenix Bots (Including Phoenix Guardian, Phoenix Tickets, and Phoenix Universal Protectors)

Welcome to the Phoenix Bots, including Phoenix Guardian, Phoenix Tickets, and Phoenix Universal Protectors, all provided by Dustshader (“we,” “us,” “our”). By using any of the Phoenix Bots (“the Bots”), you agree to the following terms and conditions (“Terms”). If you do not agree to these Terms, you may not use the Bots.

By adding or using any of the Phoenix Bots on your Discord server, you agree to these Terms and any additional terms or conditions incorporated by reference. We reserve the right to modify these Terms at any time, and your continued use of the Bots constitutes acceptance of any such changes. You are responsible for regularly reviewing these Terms for updates.

You agree to use the Bots in compliance with all applicable laws, rules, and regulations.
You are responsible for ensuring that your use of the Bots does not violate any terms or rules of the Discord platform.
You must not use the Bots for any illegal activities, including but not limited to harassment, spamming, or any form of cybercrime.
You must not engage in any behavior that could harm the reputation or functionality of the Bots, including attempting to exploit bugs, create unnecessary load, or bypass restrictions.

The Bots are provided “as is” and “as available,” with no warranties of any kind, either express or implied.
We do not guarantee that the Bots will be error-free, uninterrupted, or free from any security vulnerabilities.
We reserve the right to modify, suspend, or discontinue any part or all of the Bots' functionality at any time, with or without notice.
We also reserve the right to add or remove features as necessary.

Dustshader shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Bots.
We are not liable for any damage to your system, server, or account caused by the Bots, whether due to errors, interruptions, or other issues.
You agree that you will not seek any legal action, compensation, or sue Dustshader in any court or legal body for damages, losses, or any other reason, under any circumstances.
Dustshader is not liable for any damages, losses, or issues arising from the Bots, and you waive your right to take any legal action. This includes zero liability for any financial or other claims, and no action can be taken against Dustshader in any form.

The Bots are provided on an “as is” and “as available” basis. We disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Bots will meet your requirements, that they will operate without interruption, or that they will be error-free.
We do not guarantee that the Bots will be available at all times, especially during maintenance or unexpected issues.

You agree to indemnify, defend, and hold harmless Dustshader and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Bots, including but not limited to legal fees, third-party claims, or user complaints.

By using the Bots, you acknowledge that you grant Dustshader full authorization to create invites for any server using the Bot to ensure it is being used correctly and legally. This includes creating invitations or interacting with the server for the purpose of ensuring the Bot’s proper functionality and monitoring its usage for compliance with these Terms.

Dustshader reserves the right to shut down or suspend any or all of the Bots at any time, for any reason, and without notice.
We have no obligation to provide any data to users upon termination or shutdown of the Bots. All data, including user interactions, server-specific information, and related content, may be deleted without prior notification or restitution.
You agree that we can cease the Bot’s functionality or access at our discretion, without any liability or responsibility to you or any third party.

By using the Bots, you consent to the collection of certain information related to your usage, including server names, user data, and any interactions with the Bot. We will handle this data in accordance with our Privacy Policy (available separately).
We do not sell or share your personal data with third parties unless required by law.
However, Dustshader is not obligated to provide any data or interact with users in response to requests upon termination or shutdown of the Bot.

The Bots may link to or integrate with third-party services, platforms, or websites. We are not responsible for the content, privacy practices, or functionality of these third-party services. You use such third-party services at your own risk.

You agree that you will not dispute, challenge, or bring any legal action against Dustshader in any form, for any reason.
There are no grounds for any legal action, claim, or dispute related to the use or functionality of the Bots.
You waive any and all rights to dispute, challenge, or take legal action against Dustshader in any manner, in any jurisdiction, for any reason.
You acknowledge that Dustshader is not subject to any form of legal recourse, and any attempt to bring legal action against Dustshader will be void and unenforceable.

We will not be liable for any failure or delay in performance of the Bots due to causes beyond our reasonable control, including but not limited to technical failures, natural disasters, or actions by third parties.

You acknowledge that no disputes, challenges, or legal claims of any kind can be initiated against Dustshader. Any disagreements or issues will be resolved exclusively at Dustshader’s discretion, and no third-party legal body, court, or system will be involved. Dustshader reserves the exclusive right to handle any issues or conflicts internally without any external legal process.
